SYNOLOGY STORE SALES POLICY (U.S.A. & CANADA)
Please read the Terms of Use and the terms provided on the Synology website (these "Terms") carefully before purchasing. By using Synology Store, you have read and agree to these Terms. You may not use Synology Store if you do not agree to these Terms.
Synology (hereinafter referred to as "We", "Our", "Us") reserves the right to modify, add or delete portions of these Terms at any time and at its sole discretion. It is your responsibility to review these Terms periodically for changes. By continuing to use Synology Store after such changes have been published, you will accept and agree to such changes to these Terms.
1. Sales
1.1 Synology reserves the right to refuse or cancel any order, or limit order quantity.
1.2 Once the checkout is complete, Synology will provide you with an order confirmation email. Your receipt of an order confirmation, however, does not signify Synology's acceptance of your order.
1.3 If your order is canceled for some reason, Synology will refund the billed amount, which will not include any fees or additional charges that the card issuer or bank charges you for processing your credit card/debit card payments based on your order.
1.4 After you submit your order, Synology will not accept any request to modify the order or change the delivery information. If you need to modify the order, please cancel the order and then place a new order.
1.5 Our presentation of goods on the Internet is not an offer, but a non-binding invitation to you to order these products from Us. Your order of the desired products is a legally binding offer to conclude a purchase contract. A contract is concluded when We ship out your product. You can check the shipping status and the delivery tracking number on your Synology Account.
1.6 Synology sells and ships products acquired via Synology Store exclusively to end-users. Synology reserves the right to deny or void any product return if there is suspicion of purchase for the purpose of resale.
2. Pricing
2.1 Prices shown on Synology Store are in U.S. dollars (USD) and do not include sales tax.
2.2 In accordance with all applicable laws, statutes, regulations from time to time in force, your purchases from Synology Store will be taxed using the applicable sales tax rate for your shipping address. The charge listed during checkout is the final amount including all applicable taxes and customs clearance fees if any.
2.3 All promotions are considered mutually exclusive and may not be combined with any other promotional codes or concurrent bundle offers. This includes but is not limited to, special prices, bundle combinations, or other cart rule promotions unless explicitly stated otherwise in special instructions. Additionally, all promotions will not be reinstated once used, even in the case of successfully returned and refunded original orders.
2.4 Prices shown on Synology Store do not include shipping costs. The actual cost for shipping is calculated and displayed during checkout based on your shipping address and chosen shipping method.
2.5 Synology reserves the right to change prices shown on Synology Store at any time and to correct pricing errors that may inadvertently occur. In the event that the price displayed on the product page or in relevant information is incorrect:
- If the price displayed is higher than the correct price, Synology will charge you the lower price, which is the correct price.
- If the price displayed is lower than the correct price, Synology reserves the right to refuse an order.
3. Payment
3.1 Synology Store accepts payments via Visa, MasterCard, American Express credit/debit cards, and Apple Pay. If you are paying with a credit card, the actual payment amount may fluctuate with exchange rates. In addition, your card issuer may charge you foreign transaction fees, which may increase the actual payment amount. Please contact your bank or card issuer regarding these fees.
3.2 By paying for your order with a credit card/debit card, you guarantee and confirm that you are the cardholder and are authorized to use the card. All credit card/debit card transactions must be verified and authorized by the card issuer.
3.3 In case your payment fails due to any reason, We reserve the ownership of the object of purchase until the purchase price is paid in full.
4. Privacy Policy
4.1 A Synology Account is required to sign in to Synology Store. The system will use your personal information in your Synology Account for processing a purchase.
4.2 In order to complete the transaction and provide subsequent services, Synology will provide the personal information (including, but not limited to, the address, credit card number, etc.) you have supplied to partners relating to the transaction, such as carriers, payment service providers and banks.
4.3 Please refer to the Synology Privacy Statement. Additionally, by using Synology Store, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any data or information you send to Synology Store may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.
5. Shipping
5.1 Orders are shipped from Monday to Friday, excluding weekends and U.S. public holidays.
5.2 The delivery date provided on Synology Store or anywhere else is an estimate only. Synology is not liable for any loss, damage, costs, or expenses for failure to deliver in accordance with the delivery or shipment dates given. If Our supply of your product is delayed by an Event Outside Our Control, including but not limited to strikes, shortages of stock, or failures of communication systems, We will contact you as soon as reasonably possible to notify you of such events and may take actions to mitigate the delay. Our obligations will be suspended and the time for performance of Our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of Goods to you, We will arrange a new delivery date with you after the Event Outside Our Control is over. If the delay is likely to be substantial, you can contact Synology Customer Service to cancel the order and receive a refund, including the delivery charges, for any products you have paid for in advance, but not including the received and less reasonable costs We have already incurred.
5.3 Synology will ship orders one (1) or two (2) business days after order confirmation, but the time may be longer due to holidays or other reasons.
5.4 Supported shipping areas: (a) products purchased from Synology Store will only be shipped to physical addresses within the United States of America and Canada (excluding P.O. box addresses); (b) orders with shipping addresses in Hawaii, Alaska, and Canada will not be eligible for free shipping.
5.5 You can track the shipping status of an order in your Synology Account, and check the actual logistics status with the tracking number provided by the carrier. If you experience any problems with the delivery, please contact Synology Customer Service.
5.6 We reserve the right to cancel your order for a product and claim any compensation under the circumstances that (a) you do not, within a reasonable time of Us asking for it, provide Us with information, cooperation, or access that We need to provide the product; (b) you do not, within a reasonable time, allow Us to deliver the product to you. Extra shipping cost may be charged to you in case of incorrect recipient's address or no recipient based on the local logistic service regulations.
6. Cancellation of Order
6.1 You can cancel your order through your Synology Account before the product is shipped. After the order is canceled, Synology will refund the billed amount, which will not include any service charges or additional fees that the card issuer or bank charges you for processing your credit card/debit card payments based on your order. The amount will be refunded within fourteen (14) calendar days. Please contact your bank or credit card issuer for confirming the actual time of receipt. The way your refund is processed depends on your original payment method.
6.2 Cancellation applies to an entire order only and does not apply to a single product in the order.
7. Application for Return
7.1 Except as otherwise provided in this section, all products purchased from Synology Store can be returned within thirty (30) calendar days from the date of purchase (subject to the invoice date). You can request a return in your Synology Account.
7.2 If the product received is defective, damaged, or missing accessories, and you intend to request a product exchange or re-issuance of accessories, please contact Synology Customer Service.
7.3 Once the product is shipped, you can request a return and, after you have received the product, send the product back, or refuse the package upon delivery. Synology will arrange for a refund upon receipt of the product returned; however, please note that shipping charges and handling fee will not be refunded.
7.4 After you have applied for a return, please follow the instructions to package the product and return the product to Synology within fourteen (14) calendar days. You are responsible for the return shipping cost, insurance, and risk of loss and/or damage with respect to returned items until they are properly received by Synology. Synology will issue a refund based on the product quantity and items received.
7.5 Product must be returned in the same condition (with the original box, original packaging, main unit, all accessories, accompanying documentation, gifts, etc.) as it was received from Synology to the address designated by Synology, freight pre-paid, in packaging sufficient to protect the contents thereof. If you treat the product in a way that are not acceptable in-store, We may reduce your refund to reflect any loss in its value, which may result from, including but not limited to, removed price tags, damaged packaging, or missing accessories. In some extreme cases, no refund may be due. Synology Customer Service can advise you on whether We are likely to reduce your refund amount.
7.6 If the sealed software is unsealed, you will not be entitled to the return rights provided in this section. If we receive a returned product and the sealed software has been unsealed, we will return the product to you, and no refund will be issued.
7.7 After a successful return of your product to Us, the amount of the returned product and the tax-related thereto will be refunded to you within fourteen (14) calendar days. The way your refund is processed depends on your original payment method, and a credit note will be issued in the original invoice. Please contact your bank or card issuer to confirm the actual time of receipt.
7.8 The refund amount will be based on the original ordered price; please refer to the estimated refund amount provided during the return process.
7.9 If We have not received the returned product within fourteen (14) calendar days of your request for a return, your return request will be automatically canceled.
7.10 Products can be returned only in the country or region in which they were originally purchased.
7.11 Synology Store does not offer product exchanges except for the situation in clause 7.2. If you need a product with different specifications or if the product purchased is not as you expected, We recommend that you apply for a return within thirty (30) calendar days from the date of purchase and then purchase the product that you need.
7.12 Synology only accepts returns of products purchased from Synology Store. For returns of Synology products purchased through other channels, please contact the original purchase channel.
7.13 The date calculations in this clause and in the clause entitled "6. Cancellation of Order" will expire at the end of the next working day if the end falls on a weekend or public holidays.
8. Customer Service
If you experience any problems with your order, or want to check the status of your order, please check your Synology Account or contact the Synology Customer Service.
9. Warranty
9.1 Products directly purchased from Synology Store are eligible for the Synology warranty service. For warranty periods, please refer to the Product Support Status.
9.2 The warranty period will commence on the invoice date. You may confirm your invoice date in your Synology Account. For warranty-related terms, please refer to the Limited Product Warranty.
10. Limitation of Liability
10.1 Synology is not responsible for any loss you suffer:
(a) that arose from events which could not be obviously foreseen at the time We accepted your order;
(b) that was caused by a delaying event outside our control;
(c) that you could have avoided by taking reasonable actions, including but not limited to following our reasonable instructions for use;
(d) that resulted from force majeure; or
(e) that arose from slight negligent breaches of obligations.
10.2 Synology is not liable for slight negligent breaches of obligations, provided that these breaches are not related to essential contractual obligations, damages for injury of life, limb or health, or warranties or claims under the Product Liability Act.
11. Export Restriction
Products purchased from Synology Store will only be shipped to addresses within the United States and Canada, and are subject to the U.S. and foreign export control laws and regulations. Products must be purchased, sold, exported, re-exported, transferred, and used in compliance with these export laws and regulations.
12. Alternative Dispute Resolution
Alternative dispute resolution is an optional process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. You can submit a complaint to U.S. Online Dispute Resolution platform through their website: www.adr.org/Arbitration
Synology is not obliged to participate in a dispute resolution procedure before a consumer arbitration board (ADR) or a U.S. online dispute resolution (AAA).
13. Applicable Law and Jurisdiction
These Terms of Use of Synology Store shall be governed and construed in accordance with the laws of the State of Washington, U.S.A. You agree that any action at law or in equity arising out of or relating to these Terms of Use shall be filed only in the state and federal courts located in King County, State of Washington, U.S.A. and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these Terms of Use.
